Terms and Conditions
- Definitions
In these Terms and Conditions any reference to the singular shall include the plural where applicable, and all references to gender shall include both genders and the neuter.
“As-is” means the present, existing condition of the Item.
"Buyer" means the person who buys or agrees to buy the Item from the Seller.
“Checkout” means the secure checkout which accepts orders and take payments.
"Conditions" means the conditions of sale set out in this document and any special conditions agreed in writing by the Seller.
“Day” means a calendar day.
"Delivery Charge” means the cost to ship an Item.
“Designers, Brands or Manufacturers” means those companies who have designed, produced or manufactured the Item.
“Import Duty and Customs Fee” means any payment levied on the import of an Item..
"Item" means the physical goods subject to sale via the Website
“Purchase Confirmation” has the meaning as described in Section 2.4.
“Receipt of Item" means the point at which the Item is Signed-For on delivery (this does not have to be by the named individual on the invoice).
“Return” means the Buyer sending the Item back to the Seller.
"Seller" means Follow That Bag.
“Shipping Agent “ means the company who the Seller has used to deliver the Item
“Website” means www.followthatbag.co.uk
“Working Day” means any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a day which is a bank holiday in the United Kingdom.
“Written Acceptance” means confirmation by way of any form of electronic communication.
- Conditions
2.1 These Terms and Conditions do not affect your statutory rights as a consumer.
2.2 The Terms and Conditions set out in this page shall prevail over any other communication from the Sender or Buyer if not agreed in writing by Follow That Bag prior to Contract.
2.3 These Terms and Conditions shall be deemed acceptance in full when the Buyer completed a Purchase at Checkout.
2.4 The Seller will confirm acceptance of the Buyer’s order for goods by sending the Buyer an email confirming the goods have been ordered (“Purchase Confirmation”). The contract between Buyer and Seller will only be formed when the Seller has sent the Purchase Confirmation following checkout completion (the “Contract”).
- Disclaimer
The Seller is not an authorised dealer of, nor in any way affiliated with, associated with, or endorsed by any of the Designers, Brands or Manufacturers whose products appear on the website. All product trademarks, brand names, and logos are provided for identification purposes only and remain the property of the respective trademark holder without exception. The Seller does not claim any rights therein of any intellectual property of any third party and is not affiliated with any third party brands.
- Warranty and Liability
4.1 All items are sold As-is and therefore no warranty is given or implied to the condition of the item. Items sold described as in a '’New' condition or 'As New' remain under the classification of pre-owned. Where an item is ‘New’ this shall be expressly stated on the advertisement of the relevant Bag. It is the Buyer’s responsibility to confirm any manufacturer warranty period that may be in place.
4.2 The Seller accepts no liability at any time for defects or issues arising after Acceptance of Item by the Buyer. Under no circumstances shall the Seller be liable for any indirect, incidental or consequential damage.
4.3 While every effort is made to ensure that the item descriptions are accurate, the nature of the items means that the condition can be subject to personal interpretation.
4.4 The Seller will endeavour to describe any defects, damage or odours; however the Buyer accepts that these are subjective in nature and unless a Material and Obvious oversight by the Seller, the Buyer accepts that they may have a different interpretation and will not form any basis of a refund or compensation of any kind.
- Prices
5.1 Prices on the Website are displayed in pounds Sterling (£ GBP)
5.2 The total purchase price, including any Delivery Charges will be displayed on the Website at Checkout.
5.3 Payment must be made in full before dispatch of any goods.
- Delivery
6.1 All Items will be shipped via a fully insured, tracked and signed for shipping service within 4 Working Days of payment being cleared, unless the Seller advises otherwise (and this would be noted at checkout).
6.2 The Seller shall not be liable for any expenses incurred by the Buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
6.3 Items purchased will be shipped to the delivery address provided by the Buyer at Checkout.
6.4. Tracking details will be provided to the Buyer within 24 hours of the Item being dispatched.
- Non Receipt
7.1 In the event of the non-receipt of an Item, the Buyer should inform the Seller of non-delivery within seven Days following Purchase Confirmation. After seven Working Days following Purchase Confirmation, if the Item has still failed to arrive, and the tracking details do not indicate its arrival, The Seller can file a claim with the relevant Shipping Agents to claim compensation for the lost item. The Buyer will then receive a full refund (inclusive of Delivery Charges) on the earlier of Shipping Agent concluding their investigation and providing compensation, or 30 days following the purchase date.
7.2. If the Shipping Agent have attempted to deliver an item, the Shipping Agent will hold an item for up to 21 days. If an Item is not collected or redelivery attempted within this time frame, the Item will be returned to The Seller. For any Item returned to The Seller, the Buyer will receive the option of a refund net of Delivery Charges plus a further surcharge of £100. If re-delivery is required, the Buyer will be responsible for the costs of redelivery before the item is dispatched again.
- Returns
8.1 If a return is required the Buyer is requested to notify the Seller in writing within 2 Days of Receipt of Item and prior to the Item being sent back. The Buyer must notify the Seller by emailing info@followthatbag.co.uk and not via social media or any other form. Return instructions and address will be provided within 48 hours of notification and these must be adhered to in full in order for the Buyer to be entitled to a refund.
8.2 Items must be returned in the same condition as dispatched, with all associated packaging and accompaniments in situ.
8.3 Please note Returns will not be accepted from a smoking environment, or if the item has acquired any aroma not previously present.
8.4 Items must be returned within 3 Working Days of receipt of return instructions from the Seller
8.5 The Buyer should return via a fully insured, trackable method. The tracking number should be provided to the Seller within 24 hours of dispatch.
8.6 The Buyer will be liable for the cost of return delivery to the Seller.
8.7 Upon receipt of the returned Item and successful inspection, the Seller will refund the Buyer by the same method as per original payment. The Seller does not charge a fee for returns however payments made via Debit/credit card, Paypal or Klarna are subject to a third party processing fee of 3-4% (deducted at source) which is not refundable. The refunded amount for a return will be reduced by the third-party payment processing fee and the original delivery cost.
8.8 If the Item is returned in a differing condition to that sent, the Seller reserves the right to withhold all or part of the refund. A deduction may be made for loss in value of any Item supplied, for any loss. An exchange or credit may be issued at the discretion of the Seller and will be offered to the Buyer within 5 working days of return
- Cancellation
9.1 Cancellation instruction from the Buyer must be received by the Seller in writing via email and may take place up to the point at which the Item is dispatched.
9.2 Cancellation described in 9.1 does not result in a fee from the Seller, however the Buyer will be liable for any third party payment processing fee of 3-4% (deducted at source) which is not refundable. Refunds made following a cancellation will be reduced by the third party payment processing fee.
9.3 Once an item has been dispatched, a cancellation of sale follows the process of a Return per Section 10.
- Ownership & Risk
10.1 Responsibility for any Item outside of the Seller physical premises transfers to the Shipping Agent until Acceptance of Item.
10.2 The Buyer shall inspect the Item within 24 hours of receipt of item. If the Item is assessed to not be in acceptable condition due to damage or defect the Buyer must contact The Seller via email at info@followthatbag within 24 hours of receipt. If the Buyer fails to report any damage or defect during this period they are deemed to have accepted the goods in the condition received and ownership of the Item passes to the Buyer.
10.3 Any Item in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packaging and accompaniments. Photographic evidence of damage or defect must be provided prior to the Buyer sending the item back to the Seller.
10.4 If a Return is agreed by the Seller, the Buyer must return the Item for inspection within 24 hours of notification, at their own risk and expense.
10.5 Item and accompaniments must be received by the Seller within three Working Days of agreeing to a Return.
10.6 On receipt and inspection, if appropriate, a full refund inclusive of all Delivery Charges incurred will be issued to the Buyer via original payment method.
- Customs
11.1 All Items shipped outside of the UK will have the final purchase amount declared as contents value, as per their enclosed invoice documentation.
11.2 Any Import Duty and Custom Fees due is payable by the Buyer directly to the levying country’s custom authorities. Amounts due are not the responsibility of The Seller
11.3 For any Item returned to The Seller due to the non payment of Import Duty and Custom Fees, the Buyer will receive a refund net of Delivery Charges plus a further surcharge of £150. If re-delivery is required, the Buyer will be responsible for the costs of redelivery before the item is dispatched again. On refund. The Seller reserve the right to relist the Item
11.4 Items returned from overseas must be marked as 'Returned Merchandise'. Any Import Duty and Customs Fees incurred by the Seller will be deducted from the amount to be refunded to the Buyer.
- Force Majeure
In the event that the Seller is prevented from delivering its services as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lockdowns, Illness or Injury, Epidemics, the Seller shall be relieved of its obligations and liabilities to Senders and Buyers for as long as such fulfilment is prevented.
The Seller retains the right to suspend all or part of its services for any reason, at any time and for any duration.
- Intellectual Property
The information contained on the Sellers website and social accounts remain the intellectual property of the Seller at all times. The Seller grants free use of any of its intellectual property to a prospective Buyer or third party provided that it remains in an unaltered form only, explicitly credited to the Seller and the prospect Buyer or third party warrants that it shall not be used where a risk of any nature including but not limited to financial or reputational for your personal and non-commercial use, (for example information sharing, opinion gathering and authentication requests). Reproduction of material for commercial use is not permitted and the Seller the reserves the right to seek damages for any breach.
